The institution's ability to take action on its own instigation

Any member of the Mediation and Complaints-Handling Institution for Responsible Business Conduct (the NCP) may propose that a case be reviewed for own-initiative instigation.

There should be reasonable assurance that other potential complaints are on the way. The NCP wants to avoid interference if other potential complainants want to submit a complaint.

If the NCP takes action on its own instigation, the NCP has an obligation to ensure the disclosure of the case (cf. section 15 of the Act).

The requirements of the documentation for the possible violation is the same as in specific instances based on a submitted complaint.
